Sexual Assault offences are governed by the Crimes Act 1900 (NSW) and the penalties for such offences have increased significantly in the past few years.

In sexual assault offences, the prosecution must prove that the sexual assault occurred, that the victim did not consent, that the offender knew that the victim did not consent or was reckless as to consent. The prosecutor must prove beyond a reasonable doubt that the accused had sexual intercourse with the alleged victim and without the victim’s consent.
